Hey all, I am Michael, new to BCF

This morning on my ride home from a tour of London with some friends from around the country I hit a minicab driver doing a U-turn.

I am on a YBR 125 and just come off a round about, less than 2 miles from my house. Out of nowhere I see indicator lights and a car dart in to the road, in the split second I assume he is pulling away from the curb and veer round to the right to avoid hitting him, he didn't go straight, he carried on going round for a full U-turn, meeting me in the middle of the road.

https://i23.photobucket.com/albums/b370/M12HA3L/IMG_6681_zpsafb36306.jpg

I hope this mock up of the incident will give a better idea of what happened

https://i23.photobucket.com/albums/b370/M12HA3L/Diagram_zps0e6d262c.jpg

Bike damage: Bent forks, Bent gear pedal, broken front mudguard, bent brake lever (so minor bits)

I myself am feeling ok, muscles all over my body are not feeling great, head was starting to feel dizzy, went to the hospital for a check over and they agreed it seems to just be muscles (Neck, Back, wrists, shoulder)

Other than things like calling the police to get a crime number, go to the hospital for a check up and to call my insurance tomorrow morning, what can you good people at BCF recommend I now do ?

Thank you

Michael Ajoodan, currently working at J&S Ilford .... (( today is however my very last day ))

YBR 125 - 2006 (currently non rideable)

Someone will be along with details, but you want to use a decent claim company. Don't assume the one you're insurance company gives you is the best. You can use whoever you like. It doesn't look like liability should be an issue, what sort of speed were you doing?

You'll probably feel in more pain when you wake up! I hope it doesn't last. If you're bruised, take some photos.

Injuries often yield the most when making a claim, so don't dismiss anything that doesn't feel right.

Also, if they right off your bike, consider buying it back, it's often worth it.

Gws mate.

1. Get a call in to your insurance company. Tell them what happened, you slowed down to pass a vehicle stopped in the cycle lane on the left but as you got a few yards away he pulled out and indicated at the same time making a u-turn and you had no-where to go but try to ride around him and hope he saw you at the last moment.
If you have any witnesses all the better but your photos make a pretty good case for non-fault.

2. Report it to the cops. Take your photos and walk into the local nick to make a RTC report. This morning would be a good time since it'll be quiet. Because you have been injured, this is a requirement by law 'as soon as practicably possible'. You should have called the cops from the scene really so they could have nicked the blind fucker right there. If you have a witness and those photos they'll still nick him.

3. Use this photo in your claim form. Your sketch is good but it makes it look like there are 2 lanes. The attached photo will show that he was stopped in a cycle lane. Don't use phrases like 'out of nowhere' - you saw him stopped there, you slowed down a bit to pass and he made his maneuver with no warning and indicated at the same time as pulling out is what I imagine happened.

Without being rude are you for real?
The OP had no idea the car would be doing a U turn, if it hadn't he would have gone straight into the back of the car. Opinions like this help no one.

Uh... only if a driver fails to stop, or doesn't give name, address (self and/or owner) or details of insurance (if asked) at the scene.

https://www.legislation.gov.uk/ukpga/1988/52/section/170

If details were exchanged and nobody influential got potatoed, I'll go out on a limb and say that Dibble won't be remotely interested.

I do hope you got details of those witnesses.

Those photos should make it pretty much open-and-shut for the insurance.

Glad you're basically OK.

That Paint diagram is FAR too good to be allowed on here. Try again, using a blindfold and crayons.

If it's in London plod probably will be interested since a mini cab was involved. TFL will definitely be interested.

But OP was doing at least 60 and only turned his lights on after the crash.

Two other minicab drivers were there and saw the whole thing.

Very similar to the first time I surfed over a bonnet; except that U-turner was coming out from behind a bus at a bus stop.

You see this guy emerging onto the road from your left, naturally you turn right to avoid, but they just keep on coming until you hit. Guy who says you could have avoided by veering left obviously has never been in this situation.

Nowadays, when I see someone pulling out from a parked position onto the road into my path unannounced, I hit the horn long and hard. But if they do it when you're almost on top of them, it's too late, very little you can do to avoid an off.

Not trying to be smart here and nothing to do with the accident but you should get that front L plate correctly mounted before the plod pull you for it.

Hmmm. I know what you mean, that's the sort of excuse minicab drivers would make, but of course most modern YBRs have lights that are always on so it wouldn't stand up, would it?

I believe it's an EU requirement for all motorcycles sold new. Certainly my 2007 YBR had always on headlights.

Get lawyered up (people on here will recommend) and instruct them to tear him a new one.

Report to TFL especially if he starts being un-cooperative.

I had a very similar occurrence about 7 years ago. Someone was parallel parked and pulled out and I went into the door. Bike written off and sprained collarbone. Got cash for the bike fairly quickly and the injury was sorted about a year later to see of it healed properly, got about 3k for that.

I think you are pretty golden.
