Renewed my car insurance 2 months ago, straight forward with no hassle as per norm. My insurance company contacted me today stating my premium had increased by 110 pounds due to a claim which was made against me back in February this year, the claim was closed before my insurance was renewed without any payout from my insurance company due to a fraudulent witness statement from the claimant but was reopened last Friday apparently.
My question is can an insurance company just increase my premium when the case was closed but reopened after I renewed my policy, nothing has been paid out by anyone nor does anyone in my insurance company know what damage the claim relates to, just that a claim of some description has been made.

Insurance companies imo are a law unto themselves.

Suggest you raise a complaint with them as a first step.

I'd argue that as far as you were aware the claim was closed and so information given at time of purchase was correct.

I'd go on to argue that, as the claim is pending and the 'loss' un-known it's unfair to increase the premium mid-term especially since the initial claim was rejected and closed due to fraudulent witness.

I have complained to them but if I refuse to pay the extra they will cancel the policy, the company is Hughes which is the biggest company in N.I.

Have you full details please? I need to know what specifically they have raised; to the exact detail.

And then I need to know what the disclosures you made were, and whether they fully reflected the truth of the situation, or?

Just a pre-warning to the OP (certainly not a dig at you), arry is about to spend his own time trying to give you advice, so please give as much info as possible without him having to 'pull' it out of you.

Seen him offer to help people in other threads and its so annoying when people are too lazy to give him all the details.

Hughes have no details at all of the nature of the claim, they have no reports of damage of any kind, no estimates, no pictures, no descriptions of damage as there was none, this was also partly why the claim was originally closed. I have asked for details of any damage to the claimants vehicle but they have none nor do their claims company called M.I.S who closed the case originally yet they stated that they will be doing a 50/50 as it would cost them to much money to fight the case. I hope to have all the information Hughes and M.I.S have by post tomorrow then I intend to contact the Financial ombusman with what written information I have.

They have reduced my no claims bonus from 9 years to 4 years which accounts for the increase but this was after I renewed my policy not before or when I renewed my policy which seems a bit weird as they were aware of the case since February but never increased the premium before today.

From what you've said - which isn't full details, but....

Ok, so premium increase has come about because your NCD is in abeyance. This means that, should the claim be settled in your favour / forgotten about entirely for whatever reason then you'll get the money back.

What they've done is legitimate. They gave you benefit of the doubt on the claim by allowing the bonus - now that's gone south, they're adjusting accordingly.

Hughes did say I would have any money returned if there was no payout but M.I.S who works on behalf of Hughes will not defend my case and want to go for a 50/50 settlement even though they have no idea what the claim or alleged damage is, I have provided M.I.S with pictures of my car, pictures of the scene and maps etc as they have requested but the claimant has provided nothing other than a written statement and a false witness statement, It seems to be down to cost as they have already set aside 2000 pounds for the claim instead of going the more costly route of court which is what I want to do. This was a zero damage incident as the cars never touched and mine was stationary at the time.

Either way you are going to have to pay.
Fail to pay your current co and you will have to declare a cancelled policy. As well as having to list the open, rather than closed claim. So will end up paying more.

Erm... so what happened? Sounds extremely strange they would 50/50 a fraudulent claim.
There was a near miss incident followed by a lot of savory name calling and the sounding of horns followed a couple of weeks later with a bogus claim which to date has provided no evidence of any damage, the claimant has alleged there was a collision (I was stationary at the time) causing damage to her car but as yet has provided nothing to verify any damage other than a fake witness statement which threw out causing the case to be closed, this is the claimants second attempt but as yet no new evidence of proof of any damage has been provided but since a claim has been lodged I have lost 5 years NCB until resolved.

I have been to the police with copies of the fake witness statement and asked them if they could investigate any alleged damage to the claimants car, they were not interested stating it was a civil matter. I would have thought fraud was a criminal matter but apparently not as far as motor insurance goes, the insurance companies do not want to get into costly legal battles but prefer to do a 50/50 leaving Joe public to pick up their expenses via hiked premiums, at least that is the way I see things at the minute.

Sorry but something is not right here.
How can you go 50/50 when there is no proof of damage?

Ins co's love to tell us how they deal and punish fraudulent claims.

Stop dealing with the broker and go direct to the Ins co to raise a complaint.
