PostPosted: 10:30 - 30 Dec 2014    Post subject: Selling a vehicle - tax included or not Reply with quote

So I'm selling a car. It's currently taxed which I have just paid out for, which I intend to claim back under the new vehicle taxation laws.

A potential buyer has expressed interest in buying, but then wants me to give him the money back for the tax as he'll then have to tax it (he will pay full asking price, but then wants me to give him the money that I receive for the remaining tax).

He says 'Because I think I'm buying the vehicle with almost a year's tax so it should have tax'.

I say 'But the asking price is not taking the tax into consideration, and it's non-transferable'.

What you guys reckon? I say according to the new laws you're not buying the tax with the vehicle, but just the vehicle itself and it's up to the new owner to tax it.

Let me hear your thoughts. I know this is all a relatively new process and the first time I'm selling a vehicle under these new regulations.. thanks!

It is not transferable and is obviously being used as a bargaining point BUT that is all it is. The same as saying "can you knock a bit off as a back tyre will need replacing soon" etc.

You decide what you want to effectively sell it for, whatever a punter tries on.

He's using tax as bartering potential - you're doing the selling from the perspective that you've already set the price exc tax. Somewhere in middle there's a deal to be done. Are you happy with full asking price minus a couple of hundred? If so, no debate.

Doesn't have a lot to do with new rules, though

Yep, I'm not taking a penny less than asking price so by refunding the tax I am cutting myself short of around £130.

It's just a bargaining point, as you say - so I am going to be sticking to the new law as tax being 'up to the new owner' and it doesn't really make a different if it's currently taxed with me or not.

Tax is non-transferable. By saying "I think I am buying a car with a year's tax" he is actually saying "I know nothing about buying and selling cars". Tell him you'll throw in a couple of power bands and some brake disc lubricant in lieu of the tax.

Forgot to mention, he's a 64 year old guy that buys and restores classic Minis (mine is a 1995 model in excellent condition, that he wants to use right straight away).

He's very used to the old taxation laws where the tax is included, and doesn't get why not anymore.

He also wants me to deliver it to him in Sittingbourne, from my place in North East London.

Luckily I have another viewer coming to see the car tomorrow who seems pretty definite too Rolling Eyes Thanks for replies guys, as long as it's not just me thinking this way!

I know. I did say in the ad, "Currently taxed - (non-transferable to new owner)" just to show that it is currently roadworthy and drivable.

Just had a quick read on the DVLA site too.. Apparently your tax is automatically refunded when you send the V5 back for a new keeper change... let the hilarity ensue Laughing

Just explain you priced the car with the knowledge that you would get X or Y back for the road tax you have just paid for, so the price you advertised for didnt have any relation to the road tax you cannot transfer.

Sounds like your advert was misleading and read as though you're selling a tax'd vehicle.

But you can't sell a taxed vehicle.

I understand what you're saying, but the wording he has used is ambiguous.

Maybe the old guy does understand the tax rules and thinks that OP doesn't and therefore wants the cash for the tax as he is selling a "taxed vehicle"

If you don't want to knock the money off, then tell him that. I don't understand the need for a thread about it. I am just saying I can understand where the confusion is.

He is selling a vehicle that is currently taxed. As a buyer I want to know this because I have to tax it before I can drive it away so I need to know it is taxable. It is therefore worth putting "currently taxed" in the ad because it essentially means "on the road".

"Currently taxed - (non-transferable to new owner)" is not ambiguous.

It means nothing of the sort, and translates to nothing of the sort.

My bike currently has tax on it, but is leaking oil from the water pump seal.

My last bike had tax, but wasn't road worthy. I had a car with tax on it, that wasn't road worthy.

MOT possibly, but Tax certainly doesn't translate to being "on the road"

It being currently taxed means a test drive could be possible. Non transferable isnt something the seller can do anything about but he's mentioned it out of politeness and as a reminder of the new rules? Seems straight forward enough to me.

If a buyer has selective reading and so just sees the words "currently taxed" then that's not the seller's fault, is it?

edit: as Ste said above.

If I hadn't mentioned tax I would have been subject to a lot more stupid questions. I wrote it in the way that it is currently taxed but will not be transferred. Nothing ambiguous there at all.

I never said anything about road-worthy, just that it currently having tax means it is being driven on the roads.

My question was only due to this law being so recent I wanted to find out 'the done thing.

Thumbs Up

Irrelevant.
A private sale advert was slightly confusing. But the seller has asked for clarification and got it, so there's no ambiguity.
You agree on a price and he gives you money. Make sure 'tax not included' is noted on the receipt.

I'd generally price with some haggling room, so I'd just use this as a case of 'haggling room' - at least expect to split the difference.
If he then tries to knock it down more, you do the whole "but I've already knocked a chunk off".

Ok so you like to hand money unnecessarily to the taxman. Most of us don't. I would, as a buyer, assume that a car wouldn't be taxed if it wasn't being used on the road.

Tax doesn't necessarily mean there's nothing wrong with it but for the reasons above it usually means "in use" - why would you pay tax on a vehicle you weren't using?

You're reading into what they are saying about the textual context of Doovy's ad, too much.

Why get the tax refunded just for the period of time it takes to fix it?

Last bike had tax but needed a rear tyre, why cancel it for that reason?

Car needed a new head when timing belt snapped. All had tax before the faults, so why bother with the hassle for a small period of time?

On the flip side, I had a car with a brand new MOT, but no tax on SORN, as it was being sold, MOT was due, so I got the MOT but left it on SORN as it wasn't going to be used.

To make assumptions based on whether somebody purchased tax or not as to the road worthyness of the car is silly.

But as G said, it's all irrelevant. All I said was that, I can see where the confusion is.
