Hi, I am going to buy an exhaust tomorrow for my CBR, I have been looking at a few and I am just wondering if anyone knows,

What is he penalty for having either a race pipe or an exhaust with no baffle in?
Is it points or just simply a fine?

I was looking at one by a company called SP engineering which looked real nice and well priced too, but don't believe it's road legal Sad

Thanks

If it's got 'not for road use' stamped on it you could get done for it, more likely is that the average MOT station will pick it up and fail the bike - one reason some bikers buy a grinder....

Keep the original pipe for MOT's and if you get a rectification notice thing from the police.

heres what I did - polish off "not for road use", bolted it on a never been asked a question.

IIRC, they would have to do a sound level test before anything can be done. however a quick glance through a few google results indicate that it would most likely be either a rectification notice, £30 penalty or maybe an S59

google also indicate 83db being the limit. its is also mentioned that it should be EU marked or something along those lines

thanks for all the replies,

Looks like it is just points and a producer then, I always thought they could take you down the not fit for road route and give you 3 points!

its not a driving offence so is unlikely to give you points, just a fine. unless the copper that pulls you is a bigger prick than most of them

however, depending on where you are, how much of a hooligan you are, and how loud the results is, most copper will just ignore it as it could be classed as "a safety device" so that the cager will look for what is making the noise.

An S59 could have far more serious consequences than 3 points, theoretically, if you get stopped a second time they can seize your vehicle...

That limit is when tested under pretty strict conditions.

Strictly speaking it is an offence to have it louder than standard even if still quieter than the legal limit. But virtually no chance of being done for that.

All the best

Off on a quick tangent, does anyone know the penalty for a smaller number plate now?

From what I gather 9" by 7" is the standard size (based on letter sizing - no proper size limit)

I'm not looking to push the limits, I probably want a 8" by 6"..

Just don't want to stand out for a policeman with a chip on shoulder.

Cheers. Thumbs Up

I got stopped for speeding on my CBR with a small plate (8x6) an SP engineering can with no baffle in.

Let off with a 'take it easy' warning.

When I bought my street triple it had a low boy fitted. It was my first bike and I had no idea it was a race can and the not for road use was not in a place that was obvious. This wasn't pointed out to me when I test rode or bought the bike.

My first mot is due in June. I plan to have it done at the place I bought it from so that should they fail it they can explain why they sold me a bike that wasn't road legal.

I reckon the worst you will get is an advisory of noisy exhaust. don't panic it will be fine

I had a Low Boy on mine too, but I took the can apart and took out all the stuff inside it and took the welded-in baffle out. It got much louder with backfires that were akin to being shot in the head with an assault rifle.

I also used to live within about 100 feet of a police station, so I was around police a lot when on the bike. Never had one bat an eyelid at the bike. Reckon you'll be okay unless you give them a reason to tick you off.

Friend of mine in Edinburgh was given an ASBO for a noisy motorcycle exhaust. Not rediculously noisy, a ZX6R with an old swona system on it.

An ASBO shows up on enhanced disclosure.

Just to show the more potentially serious consequences.

At a rough estimate I'd say I've travelled 70,000 miles with noisy exhausts. I've been pulled over once for 'noise'* and was given a friendly warning.

*realistically it was for be caning it away from a set of traffic lights in a city centre.

Maybe, but my brother-in-law got pulled up on his Mille.

Noisy can
Small plate
Missing rear reflector

Copper said if he just found two things he would have given him a rectification but 3 things wrong means he had to report him. I don't know if it was a personal 'rule' or a forces policy but he got fined for each one.

Every time someone fits a loud can, the police kill a kitten.

Please think of the kittens.

My Leo Vince cans on my STR were awesome for volume, it sounded like the banshees out of hell were chasing you. I never had the nerve to take the baffles out, I reckon that would have been physically painfull.

Got pulled for speeding, bike inspected and the cops didn't bat an eyelid to the exhaust.

I wouldn't worry about it unless the 'not for road use' is obvious.

Don't sweat it, I have a slightly smaller plate on my xr and it has never caused an issue at all.

Some people on BCF may have exceeded an indicated 150mph on occasions and not been stopped - doesn't mean to say that everyone will get away with it though.

That's rather quiet... 98dB is already low enough to ensure that some roadworthy vehicles fail the test https://www.donington-park.co.uk/about-donington/circuit-noise-restrictions/
