Hi all - Thanks for looking at my post.

I'm hoping you could give me your opinions on this.
I bought a 1250 bandit from a dealer in Lancashire (I'm in Essex ) From day one the bike was problematic, battery issues, poor running, fuel starvation at low revs ect, I've broken down twice now and have come to the conclusion that the bikes a total lemon.

I'm still in the months warranty that the dealer provides, but I'm not sending back in a van for them to fix as I have no faith in the bike whatsoever now.
My question is, If I demand my money back can they no?

Firstly - have you spoken to the dealer and tried to sort this out before asking random internet people?

Secondly - where is Roger?

Yep, spoken to them previously about the other issues I've had, they've been quite good, but enoughs enough now.

Stoneybridge.

Document all the issues that you've discussed with them, tell them that you're rejecting the bike as not of merchantable quality and not fit for the purpose for which it was sold.

No discussion, flat rejection. Collection is their problem.

Whether and when you get monies back may be largely down to how you paid them. Which was?

This. It works. Ask me how.
Anyway - if you paid anything for it by a credit card (and it cost more than £100) you need to look up Section 75 Consumer Credit Act for some wordage to use. If not, you're down to them accepting a specifically worded letter (hint: Roger covered it exactly) or you notching it up to a small claims court threat. But don't just threaten, do.
Oh, and if you feel like it, name and shame.

Ok so, dealer has taken the bike back to investigate - I've been informed that the reason it has been running so poorly is because there was diesel in the tank.

Now let me assure everyone that I have never put diesel in the bike, nor have I ever owned a diesel car so it's not a mistake I would ever make.
I'm stuffed now as they can pretty much make any demands they want now they have the bike.

Dealer name to follow.

You do have the V5 though, yes? And a receipt for when they took the bike back?

Thus, if this has occurred, how can you be sure anybody have duffed up any other parts of the bike?

Reject. Reject. Reject.

Dealer has the bike and has now undertaken the work to remove the 'diesel' from the tank and where ever else it's got to.
I was not told how long the work would take or advised how much it may have been, but the dealer has now gone ahead and done it anyway.
They are charging me 550 quid, does this sound fair?

Were the problems there from day one? When did you buy the bike and how many miles have you done since then?

£550 to drain the tank and flush the engine through? They're having a giraffe!

I'm guessing you didn't? Neutral

Are you even looking at the words people are writing here for you?

Are you?

Really?

Thought not.

Unless they told you what work was going to be carried out and it's cost and you have agreed to this work prior to the work being carried out, they cannot demand payment. I'd tell them to put the diesel back in the tank and give me mai munniez

Stop feeling sorry for yourself and answer the following questions:

1 - are you going to pay attention to advice here?
2 - are you going to act on this advice?
3 - which dealer is it?

OP = https://rlv.zcache.com/nobel_prize_mug-r725c06cdf3c3450ab6f70efa2d9e9c9b_x7jgr_8byvr_324.jpg

There's literally no helping some people.

This is traditionally the point where OP starts ragefacing at us because they ignored the offered advice. Pass the popcorn
