PostPosted: 17:42 - 14 Dec 2015    Post subject: The Nazis got me, advice? Reply with quote

Two weeks before christmas and the cnuts are out in force to earn their christmas bonuses it seems...

Me and the rest of the town been parking here forever, never had an issue parking there before. And today suddenly a whole row of cars slapped with tickets on the screen, and one wrapped around my topbox carry handle! Evil or Very Mad

£110 for parking for (witnessed time of) 2 minutes in a "loading only" bay.

Im a broke student in the runup to christmas, I aint got this kind of money to spare and even if I did I'd begrudge paying it to these cockwombles.

Any advice for contesting this or how to get out of it? To me it seems that the road sign clearly says "30 mins max" so as long as I was there before that 30 mins was up, how can they know I wasnt loading? An observation time of 2 mins is not enough to prove whether Im loading or not surely? Could I simply claim to be a motorbike courier picking something up? Theres nothing on the sign that says to be considered loading you have to stay with the vehicle.

Can I get out of this? Or have they got me bang to rights?

Restrictions apply for non commercial vehicles.
If you have a trade license and were on business then contest.

If not, then Loob-up. Sad

It is not difficult to get a ticket like this. As if road safety wasn't enough to contend with. Smile

What council is this? Check their website and see if you can appeal and still pay the reduced fine if you lose (if there's one). I got off a ticket by appealing and it turned out the traffic nazi hadn't submitted the correct evidence.

I also thought they had to observe you for 5 minutes, maybe research this, and anything else that might get you off Smile

Thats what Im thinking, as the ticket was on my top box (not very securely attached mind you, just wrapped around the handle, could easily have been "lost" ) I clearly could have been dropping off documents to a local business... but will I need to supply proof of doing so?

Sutton Council. The ticket says if I appeal andl ose I get 14 days after losing to pay reduced rate, so Ive got nothing to lose really by tryint?

Google does seem to imply they watch for 5 mins, and most slap a ticket on the 6th minute, but I cant find anything concrete to support this other than everyone's ticket seems to say the same.

Actually, further to the 5 minute thing, Ive just found this: https://www.nidirect.gov.uk/further-details-of-contravention-code-25

Specifically this bit: "Contravention code 25 shall be used for non-goods vehicles (cars, motorbikes, and so on) seen to be parked in a loading bay during restricted hours without loading. A five minute observation period will be applied."

Problem is, thats Northern Ireland directGov, theres nothing similar on the UK DirectGov... but NI is part of the UK, so surely similar rules apply? Im a bit lost on this. Thinking

Liverpool Council are too scared to ask me for proof.

100% contest it, you have nothing to lose by doing so.

I'd feel exactly as much compunction to limit myself to the "truth" as their parking footpads would.

Actually a bit more digging and I might be onto a winner... maybe! Found this:

https://www.whatdotheyknow.com/request/17411/response/72068/attach/8/Contravention%20Codes%20on%20the%20TLRN%20V1.3%20Nov%2008.pdf

(which is a bit of a broken website, but if you download the PDF it shows this: )

Potentially winner?

This is interesting: https://www.parkingfinesandlines.com/ContraventionZone/Code25.aspx

Seems like "was 2 minutes enough to ascertain if someone was unloading" might be a good enough defense.

Looking at my back catalog of tickets, they say 3, 4 mins or don't specify an observation time but these weren't loading bays.

I do recall that they don't need to wait a certain amount of time after parking restrictions coming into force. Eg: 8.30-8.33 when they came into force at 8.30 Mad

Anyhoo, submit a well written/researched appeal and see what happens. You can spend ages researching lines and signage but in my experience they don't admit they're wrong.

Thats a very handy website, and certainly seems to lean heavily in favour of "constant observation must be at least 5 minutes" - would definately seem to imply that 2 minutes is not enough and the ticket isnt valid. Heres to hoping!

Middle Finger Mr. Green Middle Finger merry fukken christmas to you too Mr Enforcement Officer

I dont really want to fire off my one shot at appealing it if Im wrong, need to really find an exact answer as to whether the 5 min observation is a rule or a guideline, from an authoritative source

Leeds City Council pleasured me a couple of years back with a loading bay ticket near the LGI at 2 in the morning!!! I appealed asking for some sympathy as my father was rushed in there after suffering a stroke-how foolish was I expecting such consideration.

I got one after having an accident and getting taken away in an ambulance, which a traffic warden witnessed Rolling Eyes Then first thing the next day... another ticket, when the bike was clearly smashed up.

£110 for two minutes?
Ouch! that's bloody harsh.
I'd try the documents wheeze or at least argue like buggery over the
observed time thing

Good luck with it

Judging from similar threads in the past, if you quote chapter and verse when contesting they generally bottle it.

Why not both?

It can't hurt to hit them with both barrels!

"First of all, you nazi buttflaps, i was unloading documents to a local business.

Additionally, i note only a 2 minute period was observed by the nazi buttflap who issued the ticket, contrary to the nazi buttflap guidelines which state nazi buttflaps should observe for 5 minutes before issuing nazi buttflap tickets!"

Try and get away with it on a technicality or bullshit alone all you want.

But if you don't, remember that you flouted the rules, you got caught and you may have to suffer the consequences.

I've been there, done it and still have the t-shirt...

The rules are clear but the wardens give zero f's, five minutes my ace.
I had the same experience while picking up some lunch for office visitors, I took 3 minutes to grab some sandwiches and the note was already on my handlebar, written and well stuck, the warden was about a block and a half away. £70 in Hertfordshire.

Contest it like I did but don't hold your breath.

If it looked like that then fair enough, but it doesnt.

Heres the "loading bay" in question, theres 4 little parking strips like that on this road, 3 of which are for short term free parking, 1 is loading. As you can see, nobody obeys it and everyone uses it as parking. Easy mistake to make as well if youre not local.

what's the signage say?

Some specify comercial vehicles only, others don't, the latter I'm sure would be fair game if you were delivering something as per MCN's post.

No mention of certain types of vehicle, at the moment Im leaning towards arguing "Go and do one, I was delivering and your nazi revenue generator only waited 2 minutes, jog on."

How the fcuk the cooncil decide to paint is up to them.
They have carte blanche when it comes to parking laws (and other revenue generating stuff).

I wouldn't phaph much more on here and get over to a parking ticket website and ask.
