PostPosted: 20:59 - 21 May 2016    Post subject: False Accusation Reply with quote

This evening when visiting a customer's house, a visitor at a neighbouring property approached me and claimed that I had hit and damaged his car with my van. I told him in no uncertain terms that I had not hit his vehicle. I also pointed out that the damage to his car did not correspond hight wise or colour wise with an old scuff mark on my van that he claimed provided proof that a collision had occurred. I foolishly neglected to obtain photographic evidence even though they were eagerly snapping away.
It transpired that his vehicle was actually a hire car and I suspect that he had caused the damage himself and was looking to pin it on someone else. Things got a little heated and I ended up telling him and his two mates to get fucked (I know Embarassed). This they eventually did.
I doubt that I've heard the last of this and was wondering what might happen next and what would be my best course of action?

Block your letter box up, it's only a matter of time before they shit through it.

There's no drama. Just wait and see if anything happens, no point in stressing out.

Take pics of your van as it is right now if you're really bothered though.

Nothing you can really do apart from wait. You certainly don't want to tell your insurance about it.

I know first hand how outrageous repair costs on hire cars can be, so I imagine he'll probably fabricate some story for the hire company involving a lunatic white van man screeching into the street on two wheels and then threatening violence when politely approached. One or more dragons may feature in said tale.

My money would be on the hire company not being interested in his cock'n'bull story.

I really doubt they've got any interest in attempting to pursue a claim against you and your insurance company, he returns their vehicle with damage and so won't be getting his deposit back. End of.

What, not even if dragons are a major plot point?

Yeah, totally this. They won't care how it was damaged, they'll have a deposit and/or credit card details as standard and he'll have signed something to say they can pluck the money straight from his account if there's damage.

The best part is they write loads of obscene costs into the small print too. There's probably an excess of about £1000 that he has to pay before the repairs are even looked at. Hopefully in all the heat and confusion he'll have returned it with a half empty tank and been charged £5 a litre for the refill as well.

So, its a pretty harsh lesson if you do hire a vehicle and someone else dents it.

I was just thinking you should have misheard his entire rant and just responded with a straight out:
"What?! You want me to drive into your car with my works van?! What the hell, I'm not doing that! That's insurance fraud!" and walked away.

I'm pretty sure that most hire companies offer you the insurance excess waiver for £'s per day.

Take pictures of you van with today`s papers in focus.

This will prove that at the time the picture was taken, your van was in good order.
You could not of had the paper before it`s published date.

If they claimed you did it yesterday, do the courts really think you are going to get any alleged damage repaired that quick? after all if you damage their car, surely there would be some damage to your van?

Never hire a car without damage waiver, ever, ever.

You crash/damage, even if not your fault they will rape you. I had an Avis VW something estate written off by a JCB spinning it's bucket round and catching my side. Avis said if I hadn't had the waiver they would be after me for the whole price of the car, refundable only if they got the money back off the other insurers.

Heck, I had some shower of chancers deliver a car to me with a passenger door that wouldn't shut.

They very reluctantly sent a grumpy monkey to collect it, who spent a good 10 minutes insisting that it would ... [SLAM]... shut fine ... [SLAM] ... if you just closed it [SLAM] properly. [SLAM]

He eventually admitted that I wasn't being a girl and agreed to take it away, but of course hadn't brought anything to secure the door (because he assumed I just dinnae ken how tae work a door, ye ken) and by this point I was happy to enquire as to why that might be my problem when I'd made the problem quite clear. No, you may not "borrow" a bit of rope, grumpy monkey.

So, nearly a year later, my company got a bill through for a wrecked door on the car that "I'd" been driving, and were all "You pay! You pay damage!" at me (Y they no pay damage waiver?). Fortunately I'd done everything by email, including sending one telling the hire company that their driver had chosen to take it away with the seatbelt loosely tied around the door handle, so I packaged it all up neatly and invited everyone involved to shove it.

</BodyGuard anecdote>

tl;dr version - crooks, the lot of them. Record everything.

A colleague of mine had a hire car delivered to his home. Things changed, and he ended up not needing it but it was too late to cancel so it sat outside his house for a day.
The guy who collected it pointed out that the fuel gauge was on on 3/4, so my company would be billed <extortionate amount per litre> to fill it. My colleague pointed out that the mileage on the odometer was exactly what it was on the delivery paperwork and as such he would respectfully decline their offer to line their pockets.

I caught the side of a hired van on a pillar >= shat myself!
picked up the plastic strip and noted the broken lugs.
Stopped by car parts shop.
Couple of lugs. £2.50.

Plastic strip re-attached, light scratches rubbed back and it was barely noticeable looking for it.

Job jobbed, much relief... Thumbs Up

I rented a car in Texas and returned it with a full tank. I still got billed for the fuel. They read the mileage, calculated $many per mile and charged my credit card, only telling me this by email when I was back in the UK. When I provided a scan of the receipt I got from the filling station next to their depot, minutes before I returned the car, for the appropriate amount of fuel for the mileage I'd done, they grudgingly credited the charge back to my credit card. Brool story co.

i had a cbf 600 hire bike turn up, the guy was in a rush took mine away did a quick inventory of the bike and off he went, when i got on it to ride it i saw a big arse dent in the tank at the front, check the inventory paperwork i had and it wasn't mentioned...

rode it round anyway came to being picked up and id forgot about the dent by then untill id heard sucking through teeth followed by him rubbing the dent.

insisted it was there when i got it but he wasn't having none of it...

off to the van he goes to call his boss, half hour later comes back with "thats gonna cost ya" this point i was somewhat irritated that it hadn't been marked on the original form id been given and was a bit hard to see unless sat on the bike, told him im not paying a penny and left it at that.

bike went away with me expecting a big ass bill but got a call the next day apologising as it had been done previously and they hadn't had it repaired yet...
