Have a buddy.
Passed his test many many many moons ago.
He says he lost his entitlement a year or so ago and has been in touch with the DVLA.
After many letters and much communication they have told him they can see he took and passed the test etc however now say he never sent his licence off and was never given his entitlement as you have to 'claim' your licence within 2 years of passing else you lose it and are back to square one.

He has no copies of his old licences and as a letter from the DVLA telling him to re-take his test from scratch or sod off basically.

Are there any alternative avenues he can investigate as the DVLA are not being very helpful?

Any thoughts would be very much appreciated.

How are the DVLA not been helpful?

They investigated, found he never claimed the entitlement. That's that.

WHy doesn't he send them the pass certificate as his evidence, or has he got rid of this too? If he has, he's an idiot.

Sounds like he never had A added on, rather than that he "lost" it.

Sadly, I can't think of anything that he can do. The 2 year rule is daft, but it's in the actual statute and the phrasing is "shall not be granted", so the DVLA have no discretion here.

I'm afraid he's going to have to jump through all the hoops again to get category A.

Plenty of insurance companies over the years request a scan of your licence. Maybe he can get one of those back by either:
Checking his old emails (using the word 'licence' as a search term).
Asking an old insurer nicely if they have a copy on record that they could return.

I have scans of licences going back a good 10 years on my hotmail account. A quick check in my sent folder revealed a good few scans sent.

If he was clever, he would still have the pass certificate since it was never sent off.

He could have been 100% certain he had an A but it has gone missing. They would have asked for a certificate. And BOOM, job jobbed.

However, he has now admitted that he never got it in the first place, he has shot himself in the face.

Then again, if he was clever, he would have got the A when he first passed anyway.

He's a decent honest chap but has gone through a lot over the last few years and bikes have been far from a consideration.

I'm just double checking but am pretty sure it was physically on his licences in the past when he used to do a fair bit of green laning on his husqvarna with his son and another group a friends.

Am checking with him about any points/if he's been pulled in the past...

Many moons ago as is no idea, late 80's/early 90's...

Lost his entitlement as is re-newed his licence and he no longer had A entitlement...

Pjay - Although having never having had to do this myself I well certainly get him on him about that. Exactly the kind of advice I was hoping for Smile

If late 80s how do they know he passed his test, unless he sent them a certificate?

Sounds like there's more to this story.

If push comes to shove, it turns out that the pass certificate doesn't really mean anything. We're licensed or we aren't, and we're not licensed until DVLA Friend Computer says so, regardless of what DVSA Derek claims.

So we shouldn't really be riding away from tests. Shhh!

@lihp - I'm not sure what you're getting at?
They know he passed the test, they can see on the system he passed the test however they dispute that he never 'claimed' his entitlement by sending in his document's within the 2 year frame after passing his test.
This is the issue.

It appears after this 2 year window has passed you lose your entitlement to claim the licence and have to start again from scratch to get the licence.

If he never had the A added in the first place then fair enough, the law can be an ass but the law is the law at the end of the day and that will be the end of the matter.
Until we get hold of a copy of the licence I'm willing to give him the benefit of the doubt and I'm just wondering what's the chances he may have had a full A that's been lost and they are just fobbing him off?

Long shot I know but never say never and all that?

I'm fairly sure it wasn't computerised like it is now in the 80s. And I assume the only time they would know he has passed his test, would be when the pass certificate is submitted.

Having it all done automatically on test completion was a fairly recent thing. Even when I did my car test the only way to claim was to send the paper work off with your certificate.

It would appear I've vastly overestimated someones age Embarassed ...

2001 was the pass year so they would have registered the pass paperwork or not.
Good thinking though.

There's been a few cases of entitlements disappearing from renewed licences and even if you give them all the evidence in the world they'll just tell you to fuck off and pass another test from what I can remember reading.

DVLA are notorious for losing A entitlement.

Sadly, to the best of my knowledge, nobody has ever persuaded them that Friend Computer is wrong, no matter what evidence they provide, even if the Prime Minister writes to them three times asking them to sort it out.

Kafka would have loved this line: "The DVLA confirmed there is no way for me to take the test again unless it takes away my licence, so it has revoked it again for its computer system to then allow me to book a new test to replace the documents it admits it has seen but since destroyed"

What I would do is file a Subject Access Request with the DVLA asking for a written record of his entire licensing history. Not a precis, not whatever the phone monkey reads out, everything that they have on him including copies of supporting documentation.

Honestly though, it'll probably be quicker and less stressful (but more expensive) to just start the licensing process again.

My last year of school was in 1985, and I remember learning about the 'new computers' at DVLC when I was at school.

Let's face it'd have to be a right nutter to give the keys to your livelihood to someone high on the euphoria of just having passed their driving test. Even if it wasn't a 'condition of insurance' I for one would certainly say it was.

As many driving schools will do the Pass Plus training, then saying that they aren't insured for qualified drivers is obviously false. The emotional state of the (ex) learner is a good reason, though.

My bike school escorted you to the test centre and left. If you passed, you made your own way back to them. If you failed, you called and they came back to escort you home. It was less than a mile from the test centre though.

I seem to remember there being a specific exemption to the requirement to posess a licence if it was with the DVLA being processed.
