Morning all

Im looking to buy a new bike, however after speaking to the owner, the only part of the V5 he has is the new owners part (well, the whole right hand side sheet).

He bought the bike off his friend and has had it a while, but could the V5 cause an issue??

Thanks

Chris

Yes it is an issue.

If he's had it for a while (how long is a "while?) and is the registered keeper, he ought to have the V5.

You have to ask yourself why he doesn't which will either be (most likely) a DVLA cockup OR there is some sort of problem such as him not being the owner, the bike being a write-off, there being some sort of problem with the registration or the transferr of ownership to him not having been done by the previous keeper.

Do you want to take the risk? It costs money to get a replacement V5 if it's missing. I personally wouldn't buy a bike unless I could see the V5.

Don't buy a bike off of someone who couldn't be arsed to register it properly. What else couldn't they be arsed to do?
It's propbaly got a dozen unpaid fines on it, and a police marker too. No V5 then I wouldn't buy it.

No V5, no sale.

Find yourself a different bike to buy. Thumbs Up

It's not a total red flag, the DVLA does like to spack things up.

However, it is an issue.

The new keeper slip doesn't help. For him to do an instant change of keeper online requires the 11 digit number from the full V5C.

Otherwise, he's supposed to write to the DVLA telling them of the change of keeper. Since he hasn't bothered chasing up the V5C, I'd doubt he'll do that once he has your money (and he may not be the registered keeper anyway). So you'll have to apply for it, pay £25 (so that you can pay them more money later), and wait several months for them to try and get in touch with whomever is registered as the keeper.

The big issue is VED. You can't buy it without a V5C, or the new new keeper slip. Not the one he has. If it's got VED on it, or if you use that slip to pay now, then it'll be cancelled when DVLA do the change of keeper to you, any refund will go to whomever they have it registered with, you'll be committing an offence by riding or keeping it on a public road (but you won't know at which point you become a criminal) and you can't buy VED and get legal again until you get the new V5C though.

tl;dr version - ball ache, approach with considerable caution and eyes wide open.

I would tend to say definitely do not buy that bike. Simple rule, no V5 = NO SALE. There are a whole host of issues you could run into if you buy it - stolen / outstanding fines / who knows what else ...

Also, you can't tax it without a V5.

HOWEVER ....

you can change ownership online now which could mean he has a confirmation email confirming that he is indeed the legitimate keeper of the vehicle. Ask him about this. Details are here:

https://www.autoexpress.co.uk/car-news/consumer-news/92483/new-v5c-log-book-rules-full-guide-for-car-buyers-and-sellers

If he can't produce either or can't produce any evidence of him being the owner then walk away.

The current keeper won't have an email confirmation of the transfer though. That goes (or should have gone) to the previous keeper, as it's up to them to inform DVLA of the transfer.

The lack of a V5C suggests that the previous keeper has never bothered doing so. More fool him.

I think that the email Motorhate is referring to, is the one you have an option of sending when you process the change of keeper online. It offers you the chance to send the new owner a copy of the change of ownership confirmation, if you enter their email address.

Yep - that's the one, it basically takes out the whole postal aspect of changing owners. To quote the link I posted:

Quote:
... then, instead of filling in the rest of the relevant sections in the V5C logbook and sending the form to DVLA through the post, you simply inform the DVLA online of your vehicle’s change of ownership.

Once you’ve informed the DVLA of the changes to the keeper of the vehicle, you will receive an instant e-mail confirmation and a letter confirming the changes. If you sell your car to a dealer or motor trader, the procedure is exactly the same.

As a DVLA spokesman told Auto Express when the changes were introduced in 2015: "It is quicker and easier to transact online rather than the traditional postal route and the services are easy to use.

The letter they speak of presumably is the v5 but if its lost then the email would at least confirm that the change of owner had gone through for the seller when they obtained the vehicle. Not sure if there's a ref on there which could be used to obtain tax if you want to ride the bike there and then. If the seller has neither, I'd walk.

That, I did not know, thanks. Well, that's actually... Shocked ... sensible and helpful of them.

I'm coming to view the physical V5C as just another thing to lose now, especially as it's not proof of ownership. You really just need the numbers from it, although I guess very few people bother to make a note of them. [goes to make a note of them]

Ok thanks guys. Its a track bike at the minute and has never been on the road for years. Has all lights on etc. so at first glance looked easy to put back on the road and use as a track bike too, but the whole 'got it off my mate' and V5 thing is making me have doubts.

I'll keep looking, thanks for the advice Thumbs Up

I'm guessing he'd love to spend £30 putting hundreds on the value, but to be honest, mate, he just ain't got time, it'll fly through though to be fair, no worries.

I'd leave it unless it's very cheap. And even then I'd probably leave it, given that its history might turn out to be a bigger fabrication than the Great British Sewing Bee.

Very wise to walk away. I stitched myself up a while back by buying a bike with just the new keepers supplement. If I recall correctly, I had to wait a fair while to be able to tax the bike - so couldn't use it! As the person I purchased it from had only owned it for a week, I was reliant on the person they purchased it from actually sending off the V5, then my seller sending off the new one with my details on when he received it.

Got there in the end mind, but it was a pain.
