Long story short just left my old job and found out the entire time I was working illegal hours

I was working 7pm til 6am so 11 hours a night

The law states I should only have been working 7 hours in a 24 hour period

Where do I stand with this?

Avenues to pursue?

My reason for leave was the place was getting me down

11 hours how many nights a week

Did you sign an agreement saying you were willing to work more then 48 hours a week

Also it's got to be twelve hours between shifts

Really? I think most jobs would disagree with that. Even on nights.

7 hours? The working time directive says 42 hours per week and you can opt out if you wish.

That link says an average of 8 hours a night, not 7, and you could work, for example, 10 hours a night provided that you took two days off in the middle.

Night workers must not work more than an average of 8 hours in a 24-hour period.

The average is usually calculated over 17 weeks, but it can be over a longer period of up to 52 weeks if the workers and the employer agree, eg by collective agreement.

Most of my shifts are 12-14 hours days and nights, I can work 6-9 shifts on the row. Some times you have to work for your money.

The law isn't based on average on worked days. It's usually calculated over 17 weeks as per the link you posted. If you consistently work the same 3 on 4 off 11 hours pattern then you can just use one week to work out your average.

In a 7 day rotation you work 33 hours. 33 hours divided by 7 days gives you 4.71 hours. Well below what you're wrongly quoting as a maximum.


(EDIT:- Removed bit asking why you're complaining when you're on cushy hours. I missed the bit about it being a previous job.)

You've read the 7hrs bit wrong. It's not saying the shift must be 7 hrs long - it's saying that the period you agree to call 'night' must be 7 hrs long and has to include the hrs of midnight-5am in it somewhere. So basically you and your employer can agree, in writing, to shift the period you call 'night' back one hour or forward one hour from the standard 11pm-6am.

Nothing to do with what length hours you work.
