N00bie Going To Court

My friend has to go to court on the 20th December, he had 3 points for driving with a pillion with L plates and got caught speeding a while ago and never replied to the countless letters they sent him. He has a court date for the 20th December.

I will be going down with him. What happens there as neither of us have been before?

Do i watch and what does he do? What do we have to wear and is there anything he can do to ease the punishment (although the government is so screwed up he will probably get a 5 minute ban and £2.50 fine.

I'm supprised he was actually caught as he rides with no numberplate usually and is rarely under 130mph including residential areas.

Don't tell me about how stupid it is because i know and have tried to tell him. He wrote off two bikes already and his 04 zx6r is basically a write off now too. Laughing

If he puts in an effort, it gets the judge in the right mood. Turn up in a suit, it shows he's taking this seriously. Turn up in jeans and a shirt that says 'I Love Vagina' the judge will be less impressed.

Tell him to tell them he is sorry for what he did, he's learnt his lesson, and won't be behaving like an idiot in future. Make sure they know he thinks he's a shithead. (Which he is.)

Combine that, there's a good chance his punishment will be smaller, but he won't be let off, that's for sure.

Based on my experience.

A suit is always a good idea. But casual like, no tie, open top button. Not sure what you will do but he will be taken into the court by the usher (or whatever they call them) and asked to swear in.

Then he will be asked to stand in the witness box and the bench will ask him a few basic things and the prosecution solicitor will question him.

After that he will be escorted out of the court for 5 mins while they decide whether to hang him or stick him in the electric chair.

Then he will be asked back in to stand int he witness box and will be told his fate.

He could possibly get away with it by saying he didn't get the other court notices as he was living away from home for a while. If you do this they will question it so have a story ready (where he was, what he was doing ect). Look very sorry for himself and he must admit he knew he did wrong and has regret for it.

I'm no great criminal but i have got off scott free from a lot of things by eating a bit of humble pie and looking as pathetic as possible for the 20 mins i've been in there.

It does not matter what you wear, I tried that one for being a naughty girl once. His best option is to plead guilty and offer to pay the fine in installments.

The prosecution soliciter will be a lot quicker than some made up story - the more you make a story up, the bigger he fine.

Just get him to tell the truth and bend over.

He will go in, the clerk will ask him to confirm personal details, name DOB etc.
Clerk will put the charge to him, ask for guilty or not guilty plea.
I assume he will plead guilty.
Crown Prosecution will put the details of the case.
The bench will ask why he has ignored the letters and he can try to lie but I doubt they will accept it.
They will likely just sentence without retiring as they have loads of numptys like him stood where he is day in day out.

He can get a solicitor prior to the hearing if he thinks it will help, or he can see the duty solicitor at Court on the day.

You, as can anyone over the age of 14, sit in the public gallery and watch any case as long as it is not youth Court.
