Hi all i had no fod for work today so at dinner i popped up to asda , on the way back i got stuck behind a lorry turning right , i stopped , slowly started moving to about 10mph there was enough room between the lorry and kerb so i swerved to go around it then as i accelorated my back wheel was on a patch of ice from a leaking drain and i came straight off.

Im fine just on a downer , pissed of and sad lol

Bikes left side fairing is scratched like mad the left side on the front fairing is , my gear lever snapped off and i lost both my front indicators , so im gutted

But ive been told i shoould be able to claim as the drain shouldnt have been leaking.

Better happening on an rs125 than when you get something big and expensive Thumbs Up

At least you'll have a winter project in fixing it up - doing your own bodywork is very satisfying

glad your ok. does suck somewhat though.

as for claiming against the council or whoever, you may need a bit of luck. it is VERY hard to prove liability, especially if you say things like "i swerved". They will say you just lost control of the bike, whether you did or not.

rs125 fairings often pop up on ebay for about £30.
id watch ebay for a bit until the right one comes up rather than getting a new one or respraying or whatever

might be good to leave it until after winter too just in case you come off again

i am selling it lol its on autotrader , thats why i feel so crap lol , cant sell it now , got a lot of work to do aswell , its done loads of damage to say i was going so slow

I was in the same situation when I binned my scoot, someone was coming the very next day with £995 cash, unbeknown to me (they phoned my dad whilst I was out, they'd been to look at it earlier but didn't seem keen).

First I knew of it was when I phoned home;

"Hi dad,"
"Hello, those people are coming back tomorrow to buy the moped"
"Oh... right, about that.."

Embarassed

Glad you're OK though, unlucky I guess, just fix it up and sell it on again, you may even have a better market if it's closer to summer when you sell it Thumbs Up

I'd be amazed if your claim about a drain that was wet got anywhere.
Drains are wet aren't they, then when its cold they get icy.

If it was leaking you might have a claim against the drainage commision, whoever installed it, as it's a safety hazard which shouldn't have been there. I'm no expert on these though, no best ask a proper company.

I do remember some guy got a shedload of compensation from BT because their wire over was about an inch higher than the pavement; he tripped up, broke his hip, and cashed in.

Thats a point but the question is should you have been that far over to be in the gutter ? Not sure if that would have any bearing ??
