Knackers - Dumped it

Crashed my FJR Sad

Extreme slow speed crash.
In a shopping centre car-park, my right of way, People Carrier pulls out of junction on my right , only yards in front of me.

I attempt emergency stop, lose the front end twice, save it twice. Very greasy road & was only doing around 15-20mph, couldn't quite stop in time. Hit the drivers front left wheel arch.


Damage, my funky windscreen that raises & lowers now does niether and is held on with duck tape. Front fairing smashed by still attached to bike, headlights knocked back into the body.



no witness :/


Cheeky sod now claims I was speeding and on the same road as him???
Insurance sorting it out, but they think he is lying after reading my full A4 sheet of the accident despcription, with carefully ruled drawings.



What can I do to him?
He admitted fault at the scene "Sorry, I didn't see you mate" but is now denying it.

He is surely lying to the insurance company, is that not classed insurance fraud?

Its a major shopping car-park so there may be CCTV about, will double check tomorrow in the light. Is it possible to get them to check to see if they caught the accident?

Also can I get him prosecuted if he keeps this up. People like him are scum, essentially grown up scavs that don't have the human decency to admit their own faults.



N.B.
I hope I come across him in a bad accident, roll up. See the flames, pop the helmet up. Point and laugh for a good while. Throw rocks at his head etc...

Are you sure one of your friends didn't happen to be in the carpark and witness the accident? Wink

Go down the CCTV route, if that doesn't work out then play dirty.

That is a sod.
Lucky you weren't going quicker, but probably more plainly annoying eh.

I reckon to prevent another huge thread full of advice on how to exact revenge you should:

Put dog turd under his door handles, smash his windows, leave threatening notes, murder his wife, kids and dog, burn down his house. Oh and kick off his wing mirrors.....

Seriously, the CCTV sounds like a good bet.

What gets me tho, is how can they not see a bike????! In the dark maybe its slightly harder, but in the day time there is absolutely no excuse.

For most bikes over 125 cc you can here the bloody things as well as see them, its down to pure laziness and the "FUCK UM" attitude that car drivers have.


It really isnt hard to see bikes, when im driving my car i wear glasses and can still see a good 500/600 yards up the road.

A lot of people in car parks seem to just ignore right of way, especially those in big people carriers or 4X4s who use thier vehicle as a barrier and expect everyone else to move out of thier way or avoid them as they are the larger vehicle.
The bloke probably didn't even bother looking, he was only looking for a gap to get into, or to get out of the car park.

years ago when i was unfortunate enough to be a insurance broker, most of the private car polices stated you should never admit fault even it is was your fault you can say sorry but not sorry its my fault, at the end of the day its this insurance companies that sort it out, they ask the question who was at fault, him saying it to you means nothing unfortunalty, i really cant understand people who change there story it iratates me to say the least we all make mistakes, just put your hand upto it, thats why we pay insurance.
but unfortunalty some people are wankers..........................welocme to life

p.s people i resent the 4 x 4 comments Very Happy as i have one. (pick up for work purposes) but agree that alot of people who drive 4 x 4 or chealsea tractors as i like to call em should be made to have a twingo Smile after all the only off roading they ever do is parking on the pavement

Sorry to hear about your accident Crying or Very sad 4x4's should only be driven by people with bike licences - so they are more likely to be aware of what's going on around them. They are very handy for carrying loads of kids (I have four and am allergic to rubber) and lugging stuff around, as well as scaring your average cager into giving way!! Wink

always carry a disposable camera in my car and in my bum bag when on the bike, as soon as incident happens takes some shots, stops the other party lying and instant witness

Carry a camera I say; I really should get one for my bike. The mere sight of it will make them be honest later on, even if you have no film in it (just pretend).

15-20 mph in a shopping centre car park? Tut Tut WAY too fast for the kind of morons you are likely to meet in such a place.

Incidentally, I kind of have it in the back of my mind that a car park is not considered to be a public highway except in certain circumstances, and the markings and signs in it are therefore advisory rather than binding? This can also cause problems with insurance claims IIRC, as he cannot be done by the police for an offence committed on private property.

Lying bastard, same thing happened to me by hit'n'run driver. Get yourself a witness and stiff him.

Get your 'witness' to goto the shopping center and say he saw what happened, leave his details etc.

You go to shopping center later on and ask about CCTV, and 'presto' they tell you a witness left them his details... Thumbs Up

Update.

I've won.
Collecting the bike for repairs tomorrow and giving me a hire bike (Apparently they have some kind of 1200 I may be able to get) in the mean time.



The other guy kept changing his story.
Started off with me in the same lane as him speeding. Then managing to hit his front left wheel arch????


After I sent full drawings and photo's of the site (reminding them that it is covered by CCTV) he changed his tune when he had to send in his sketch of the accident.


So now he admits pulling out, but that I was speeding.




Insurance say its pretty clear cut now as he is not able to judge speed correctly. So repairs and hire bikes all authorised for me.

Kick ass.

Hope you're ok though. Stick to your guns and don't let him get away with it. Had an incident a few years ago where the woman told me I couldn't claim against her as it wasn't her car! WTF? She was driving it! Don't let it go...his lies will trip him up in the end.

Technically denying liability for a accident is not fraud.

Fraud is him staging or semi-staging an accident or claiming for losses not suffered

Glad you got it sorted. These things can be messy.
