Posted: 21:12 - 02 Apr 2006 Post subject: That insurance claim - an argument |
 |
|
I don't want to start this on Andy's news & get well thread.
But I'm puzzled as to why some of you seem so angry that the woman whose car was damaged by the bits of his bike wants to claim off his insurance.
Isn't this exactly what insurance is for? So that if your actions cause a problem for an innocent 3rd party they shouldn't have to be out of pocket?
Isn't this exactly why bikers get so angry when cars drivers pull out or change lane, the biker brakes & lowsides/drops their bike and the car driver drives away cos the bike didn't hit it? Because the person to blame for the damage to their bike or themselves has "got away" with it?
Difficult to argue the case impartially without knowing the full facts about the crash but by all accounts the woman in the car did nothing wrong. In fact to see what happened to Andy either alongside her or in her mirrors probably shocked her to the core. So why should she pay herself for the damage to her car?
Don't get me wrong, I'm hoping against hope that Andy will be OK. But just because he was badly hurt doesn't mean he was blameless.

I agree that she can claim but I'd of hoped she'd not have made an issue of it at that precise moment......... ____________________ Always believe that your guardian angel flies a bit faster than you............... |

I agree that she shouldn't have to fork out simply for being in the wrong place at the wrong time, but it's hardly a bumper shunt, is it? There's poor Andy in critical condition, and she's worrying about her bloody paintwork.
And Stink, I assume you were joking? NHS and all that? |

Rookie, have you been in or witnessed a bad accident?
Your brain kind of goes into "talking bollocks" mode cos of the shock, and sometimes you can only focus on one thing no matter how daft, insensitive or inconsequential it is.
Or you might all be right and she's just a callous bitch. I dunno. ____________________ Sod falling in love, I wanna fall in chocolate. |

If you're considered "at fault" then the NHS will usually bill you. Leastways that's how I've been informed by at least three A&E departments. Luckily it's usually been someone elses fault in my case

I got billed once about 10 years ago. From memory it was about 60 quid for the amulance to the hospital and 15 quid for a check up. ____________________ Past >>>> Honda NSR 125 >>>> Suzuki GSXR 600 K1 >>>> Suzuki GSXR 600 K4 >>>>Kawasaki Z1000 DAF >>>>Suzuki RMZ 250 >>>> Current >>>> KTM Superduke R 1290 >>>> |

Perhaps there were other factors involved with this.
My father was never the most resonable man. My mum had an accident in his car once, and the row lasted a full 2 hours (him efing and blinding at her). Even though it was someone elses fault, he went mental. He blamed her for using it in the first place. It was very unpleasant.
So none of you know exactly what her motives were, but if it was a similar situation to the one above, I can fully understand why she was so worried about the damage being repaired.
Perhaps like me she has incurred damage through uninsured drivers and is now unwilling to take the risk, hence asking at the seen and trying to ensure that everything was checked there.
At the end of the day, most of the people who seem to be upset about this are the people struggling with insurance. As you get older, it becomes just one of those things. You let them get on with it and don't worry. It would be naive to think that this incident won't affect Andy's insurance (the accident, not the lady claiming).
I think that is the least of his worries at the moment. These things (insurance) tend to work out in the end. Its never as bad as it first seems. ____________________ Travelling around the world...a bit at a time. Where am I now? / Visit my BLOG
