Speeding in the dark?

Can't see that one helping, fingers crossed, do you need the bike to get to work? That may well work in your favour. Almost double the speed limit... ah well, i think i do about that daily in a 30 zone with speed humps on my way to work (no working speed gauge so only way to tell is how quickly i meet catch other cars) so I can't comment... and I'm sure many other people here can't either.

Good Luck Bud

Yea they did mention that speeding in the dark is not a good thing. I'm hoping the courts will be lenient on me as it was quiet and in a nice stright line. I'll soon find out. Just a notice do the police have to give me any thing such as a ticket or producer etc? Cuz they didnt. They just took my name driving licence details etc.

Think they need to put something in the post within 14 days but wait for Kickstart... he knows everything.

A fine wont go down to well either as I dont have a lot of cash. But there we go.

Don't worry... they're so used to people not being able to afford to pay fines that they even have finance agreements on them these days Very Happy... you won't have to pay anything for the first year (not sure what the agreements are guess it depends on the fine :S ).

Sorry to hear about it, Scott. It's a very mature and refreshing attitude you've got. Hope it won't come to your losing your licence and affecting your job prospects. Karma

Hi

They need to inform you that you will be prosecuted within 14 days, but they have done that verbally at the side of the road.

Generally 30mph over the limit is a ban Crying or Very sad , so pretty likely for 40mph over the limit.

Be interesting to see what they really do you for, as from the sound of it they might well not have actually clocked you at 90 for any relevant distance (if at all). Might well be that they will do you for a lower speed.

All the best

Keith

Also, do you think pretending that you've lost your license might be a good idea?

If you do get a ban don't you have to surrender your license? Might be wrong here, feel free to correct me someone. If you pretend that you've lost it you can keep hold of it and still have it for use at trackdays etc.

As a matter of interest were you caught by average speed or just video evidence of the car following?

Knowing the justice system in this country you will more than likely get a fine and some points. If however, you were a scally and you were riding a stolen bike with no tax, mot and insurace you would get away with a warning.

No Anders you're wrong, they have six months to present the case to the magistrates, ie hand your details and evidence over, they then have 3 years to issue you with a summons although it doesn't take that long obviously.

If you get caught by a camera they have 14 days to get the NIP to you, this isn't needed in this case because he was informed at the side of the road of their intention to rape him in court.

I had reason to look into stuff like this recently. Wink

But this 14 days is not right either! they can issue one months after which will porbably be the case.

They can only issue the summons if they have issued a notice of intention to prosecute within 14 days (with a few exceptions). Yoko will have got this at the side of the road verballly.

All the best

Hi,

Do some research of your own, and consider a solictior.
I have heard good things about Robert Dobson at https://www.prycewoodrow.co.uk/

I may be worth considering a ban, sometimes a short ban (1 month) can be better than points leaving you on the edge for 3 years.

Regards
C

A solicitor may get the ban decreased, I have heard of a ban for 1 month with a fine, you’re going to be banned anyway so find out ASAP some costs.
When you go to court with a solicitor, he/she should sort it out for you, I have actually heard of it going tits up though.

If you go to court without a solicitor and want to face the guys on your own, make sure you don’t crumble, they have heard it all before and ask questions to mess with your head.
It sounds like you were travelling home or something quite late, and decided due to the road conditions it was alright to have a short blatt down the road which is something you should get pointed out solicitor or not.

Hi

There is a good chance that it could take until the end of summer before they get you to court anyway, so with any luck the ban will be in winter.

Fine wise they are means tested, so that £1k fine might relate to someone on £100k a year.

All the best

Keith

Yeah, turning up for a court appearance for speeding when you have been banned in the mean time would not go down well!

All the best

It's interesting to see that although all the relevant law is available from the HMSO website no one with the exception of Mr and Mrs Kickstart can be bothered to read it.

Would people please stop talking shite about a subject they know nothing about before someone is convinced to do something stupid.

Sorry to hear it Yoko. Look at it this way, if you speed then sooner or later you will get caught - it's a simple numbers game. It's a matter of time (could be 10 minutes, could be 10 years). No reason to feel you did anything too bad really, 90mph on your bike on a straight road is hardly caning it.

A lot may well depend on your magristrate - if it's in an area where they see speeders day in, day out on big roads, you might have a better chance of leniency. As opposed to (for example) speeding through a village deep in the countryside.
