The spill list that is Thumbs Down

On way to work tody, ended up "introducing" myself to the side of a car. Story as follows:

Coming down local road, 60 limit doing 50, good visibility, 3 cars ahead of me. car 1 is at the front, then car 2, then car 3.

Car 2 & 3 starting indicating left and moving over, car 1 didn't. I decided to go around all 3 cars, at which point car 1 turned right I ht the anchors and shed off bit speed before walloping into side car 1. At no point did i see any indication.

I'm alright, the protective gear did a very good job and i'm left with a swollen foot and few bruises.

Bike is similar, broken bikini fairing, forks and frame look fine, as does front wheel. No damage to tank or rear. Engine runs fine, but got 2 broken footpegs and front indicators and bent brake lever Sad R & G's saved my bike i think, one best 60 quid i think i've spent.

See the pictures. I have a feeling its not going to go in my favour at all, just wondered what the consensus was? I don't want to start bitching at the car driver but if there was no idication to go right.

Anyway hopefully be back on the road soon, but there goes my 4 years no claims, the car door looked mashed, and somehow i hit the car, the kinda slide along it so theres damage to both the rear passenger and driver door Mad

Keep your witts about you guys, i can't beleive i'm sitting here nd not in a hospital bed or worse, its not often yu come away this lucky i don't think Sick

What did the witnesses say?

Did they say they didn't see him indicate?

I can't see you winning the case even if everyone said that car 1 didn't indicate though to be honest. Not overtaking at junctions is something they drill into you for ages.

I dunno what the witnesses said, but she got out the car turned to one of em and said "i'm sure i was indicating" Rolling Eyes

i read that as "i'm NOT sure if i was indicating" dunno if anyone else would.

Whilst i'm here, anyone got any footpegs that would fit in my bike (Bros 400) i know NTV ones do and if it comes to it i'll steal the ones off my dads until i find some others as he's doing the bike up at the mo, got it as non runner

Glad you're ok, but dont think you'll win a lot of sympathy with the powers that be, overtaking on approach to crossroads, we've all done it at some time or other, your number was up!

No offence, but it's pretty much your fault, if there is a crossroads and people are indicating you should probably use some common sense and realise the chance of someone turning right is quite likely.

Yea i guess so, hadn't thought about it like tha, like i said i wasn't going to rant about the driver, no point, just gotta learn from it, crazy thing is 9 times out of 10 i would just sit and wait till they move off, dunno why i didn't today but its done now.

I'm sure there are easier ways to get time off work Confused

Unlucky and glad you are able to walk away from it but I would have to put the blame with you on that one. The driver of the car should have checked the mirros before turning but you could have been in the blind spot by that time anyway.

Did you exchange insurance details?

I'm confused.

What is so ambiguous about "DON'T OVERTAKE AT JUNCTIONS" ?

Who would you blame if the tables were turned and some idiot T-boned YOUR car ?

Hotdog.

ps. DON'T OVERTAKE AT JUNCTIONS

yea although she was at fault aswell, it will turn out to be your fault im afriad as you should have overtaken if unsure/at that place.

It sucks esp if she wasnt indicating, turst me the same is happening to me and had finacilly kicked me in the balls and having to be in debt again, paying off another bike AGAIN!!!

You've never EVER done it then? Never overtook whilst passing a side road?

And anyway i was not completely blaming the driver, i said she didn't indicate which leaves her at fault too i wanted to know what the standings on it was

Just seem's like a very stupid maneouver that you got caught out on.

If I were the car driver i'd fight you tooth and nail, he'll probably win too.

some people dont do risky things

I hardly ever overtake, but this is partly because Im not very good at it so when i do its more risky than it should be even if i only do it on a long clear straight.

Other bikers will overtake but wont filter so they zoom past me but then stop in traffic while I go past.

If you didnt get witnesses saying she didnt indicate, its just your word against hers, whereas you did overtake on a junction which is advised against in the highway code.

Unlucky mate, at least you are ok. Thumbs Up

I'm afraid you might be bang to rights on this one. The driver has a duty of care to make sure it's safe to perform the manoeuver, but it's easy to be missed approaching if you perform a multiple overtake. It might be that you just didn't see the indication.

I would think it'd be a bit of a miracle to get a win out of this one. It's one way to learn though.

But you shouldnt overtake near a right hand turn anyway.

Got to assume that everyone else on the road is an idiot. Confused

Bad luck mate, I think the tendency to overtake on the approach to crossroads stems from them usually being on the first decent straight after a long set of corners (almost always true where I am). Hope you can sort your bike out cheaply Thumbs Up
