My crash

as you my already know i can a crash on saturday im ok, just very sore and walk like a cripple.
First off i bought a New bike, to get to and from work on
a 2 stroke RXS100 having picked it up put it in the van and took it home, it was running a little werid so i take for a spin round the block half way round a taxi comes out of no where trying to do a 3-point turn i guess, i plow straight over the bonnet and total the Rxs with a max speed of around 30 when cold.
rolling around on the floor in extreme pain and shock for about a minute, taxi driver does not get out of hes cab, people from houses nearby come and help.
Police and Ambulance come and im carted off to nearby farnbourgh hospital.

Now heres to dodgey stuff, i wasnt insured when i had the accident. only to find out today my GSXR policy covers me TPO on other bikes not in my name.
the old owner already sent off the V5, same day
The cab driver told the police i was doing 40mph with no lights on, but if he saw me doing that, why did he still pull out ?.

Yeah, most policy's cover other bike, but usually only if they are coverd by the owner. Its not always the case, depends on the policy, but you might want to check it.

Just tell the police that as you realised that there was no way of avioding the taxi, you did notice that the driver was looking the other way (Driving without due care and attention). You could also ask why he pulled out on you if he did see you (dangerous driving).

You have to also convice the police that you were in no hurry what so ever to get anywhere, and had no reason to be speeding, and would not do so on that sort of road (with parked cars etc...).

Well i'm sure whoever you bought the bike off will tell the police that it was still in their posession at the time of the incident.

When I got hit the first thing the driver said to me was that I was speeding. When I told the police this they said well he must have seen you then and proceeded to prosecute him

Good luck with the insurance stuff - I've been up in court before for no insurance and whether or not I was covered was a bit of a grey area. I got let off so it's worth fighting.

Just say this to the police:

I was in no hurry to get anywhere as I was trying to get a feel for an unfamiliar bike. I had already tested the brakes and the steering carefully and was heading home. The taxi pulled out of nowhere and the driver was looking the other way. I saw the taxi hove into view in the beam of the RXS headlight and was not able to stop in time to prevent myself from hitting it. The taxi driver did not even leave his cab to help me, luckily I could only have been doing 20-25mph otherwise I would have been hurt much more than I was. The road was residential and I make a point of not going faster than about 25mph in those areas.

Dead cert he'll get prosecuted especially if you have corroberative witnesses. If he has witnesses then it might be harder, but still doable.

Glad you're alright, you numpty. Who would have thought you'd be safer on your GSXR than a 100c two stroke!

His claim of your speed will have no impact what so-ever. He hasn't got a radar gun build into his head so he's not qualified to make the claim. I've heard of cases where Policemen have made speed claims get thrown out because they had no evidence. So a taxi driver's got no hope. And, like others have said, if he saw you coming why did he pull out?

The bloke's obviously a knob for not getting out of his taxi after you crashed. Sting him for all he's worth

Hi

Hopefully with the insurance cover you should be OK. I presume Cliff said "you bend it, you bought it".

Not seen a policy saying that any other bike you ride must be insured (although some may well), just that if you are riding a bike like that and park it up then it is not insured.

If that were the case, then there would be nothing stopping you from insuring your 50cc moped for £100, then going and buying an R1 and riding it under your moped insurance. I think you'll find the other bike does have to be insured.

So did the taxi do the u turn from being parked up, or were you following it down the road when it slowed down, you went to overtake and it hit you when it cut across your path ?

For my tuppence worth, I'd avoid using in any formal communication the words: came out of nowhere. It could be construed as poor observation on you part. Don't leave yourself open to this.
