 |
|
Hey guys,
My bike was stolen just a couple of hours ago in North London. I've just reported it to the police and wondering now if I should report it to the insurance (third party only) straight away or wait a few days/weeks to see if it gets recovered?
What about the DVLA? Should I contact them tomorrow quickly?
So annoying when these thieves go around just taking whatever they can...arhghghghhg
Any advice much appreciated!! Thanks...

To be honest I would get a picture posted up here straight away with another form of contact details... post that in the location settings and in this thread. Just encase anyone sees it on a ride out later. ____________________ CB125>CG125>GN125>ER5>K100RS>R1100RS>K100RS

Aw, gutted for you. Maybe they stole it because they had a bit of style and taste, the worthless scum.
Sadly I don't think there's a particularly good answer, but after a brief search for the bike, I'd call or email the insurer, instruct them to cancel the policy, and decline any invitation to tell them why.
This is because if it gets stacked and the policy hasn't been cancelled, there's a chance that they may be obliged to pay out to third parties and they may then be able to recover their losses from you if you've left them unreasonably exposed to risk. I stress may because it's not certain, but it's a fairly big risk to take.
T.C. would likely be able to give a more definitive answer, I'd suggest P.M.ing him. Since it's such a sadly common occurrence it might be a good one for a sticky. ____________________ Biking is 1/20th as dangerous as horse riding.

Around that area!, I walked around Golders Green last night, just in case they took it just to cause some inconvenience, but nothing
Many thanks!!!!
I'm not expecting it to be recovered, I think they'll use it for parts! so now I'm more worried about reporting it to the insurance (with premiums going up, etc, even though I won't make a claim) or not :S |

I don't mean to over-alarm you, I don't think it is likely, but it is a technical possibility based on the my understanding of the statutes and the current case law.

The law doesn't necessarily agree. The latest case law that I'm aware of is of a works van that was essentially TWOCed by a Yoof who wasn't on the list of approved drivers.
He stacked it and the insurer tried to get out of paying out to a 3rd party on the basis that you stated: that he wasn't an authorised or agreed driver. No go, they were made to pay out, partly on the grounds that they had deep pockets and the 3rd party shouldn't lose out. Now, I don't think they pursued the policy owner for recovery, but that's not to say that that they couldn't do it in future if there's an clearly identifiable and unreasonable failure to limit their liability.
It's a big stretch from there to a pikey riding a stolen bike, but the bike has an extant policy on it, I'd expect the claimant to go after that first.
Again, T.C. is your man for a more definitive answer, it's basically his job to follow the twists and turns of Their Lordships' meanderings in this area. ____________________ Biking is 1/20th as dangerous as horse riding.

Happy to help, and again, I'm sorry that you're going to be punished for being a victim.
Did T.C. recommend telling them that the bike has been stolen, or just to instruct them to cancel the policy without a reason? ____________________ Biking is 1/20th as dangerous as horse riding.
