So coming home today there was a police check point. I was following a few cars (I was about to overtake), & thought oh $hit they're going to pull me aren't they... sure enough they did. The copper starts looking over my bike, & says the fork seals are leaking, and that he could declare my bike unsafe (or something) which would result in having to obtain a new mot & points on my license. Instead he gave me a talking to.
Tbh I've never heard of people being given points for this offence(?). I'm a bit nervous of being pulled again, although obviously I'm going to take a different way home tomorrow  ____________________ Yamaha MT-03 '08 (crashed)

He said the front tyre was quite worn (which it's), although its legal. Still he seemed more concerned about the forks, saying about it dripping onto the front brake. I didn't tell him that literally a few minutes earlier I had to do an emergency stop when a kid walked out infront of me  ____________________ Yamaha MT-03 '08 (crashed)

The could probably do you as part of the Road Traffic Act if they really wanted to, however if you can prove that the vehicle was in a roadworthy condition when you did your pre-ride check (which you always do ) then I think it would be nigh on impossible to make it stick.
Obviously stuff like tyres it won't be a defence for, but blown bulbs, fork seals, number plate getting smashed to pieces, that would be a reasonable defence IMO.
ANy legal bods feel free to make me look stupid, but that's how I'd interpret it. ____________________ My Flickr |

He can't "declare" anything, he can make an accusation and let a court decide. Unless you're daft enough to admit to it and just hand your license over and pay a bribe to avoid a day in court.
For future reference: Road Traffic Act 1988 Section 67 (6): "I elect to defer this test, now either detain me or I'm riding off."
The law is available for you to read. He won't have, but that doesn't mean that you can't.

Heh, the first result for me is the Road Traffic Offenders Act which lists the penalty for obstructing a roadside test.
To be honest, I wouldn't actually recommend trying a deferment unless you (or better yet, a chumrade) are able to record the interaction and you're up for seeing it through all the way to court.
Your "right" to defer is writ down offishul like here. Note the exceptions to that right: an accident, or "Where in the opinion of a constable the vehicle is apparently so defective that it ought not to be allowed to proceed without a test being carried out".
That's very vague, but obviously pissing fork seals would likely trigger it.

Obviously I didn't argue with the copper (it's all about power with them). Taken a pic of my fork seals. Don't think the van crashing into me today helped. Taking a different route home today took 10 mins longer tho', so I want to fix it just incase I get pulled again. ____________________ Yamaha MT-03 '08 (crashed)
