I love the way Killa manages to surround himself with stress. He's either stressing over somebody's post that he misread, or making other people rage at his childish posts and remarks.

I love it! Laughing

But it wasn’t moody Jon.

Saying my bike is worth more than EDbanger has to be funny, no?

It was a joke Jon, yeah, I too laugh at my own stuff.

I didn't think that you actually "lost" your licence, you just need to re sit the test ?

i was doing a bit over the limit the othe day, then at the last minute noticed the pig van on top of the bridge, but i was heading towards it. and when i had a look back though my mirrors it wasn't there. not sure if it shot off after me or i just couldn't see it because it was on the other side of the bridge.

Hi,

You can have 6 points in th first 2 years but not more than 6 so if Killa got 3 points he would be fine.

Also I do think you should make sure they applied the law to prosecute you, they do get it wrong both in terms of the bike/car involved and the actual speed.

Unless you are sure you were speeding at that place and time it might be bollocks

Hi,

Oopps I was wrong maruice is right,

Good news is you dont have to redo each test just car or bike.

Regards
C

Quote:

6. The Road Traffic ( New Drivers) Act 1995
This Act will affect you if you passed your first GB driving test after 1 June 1997 when it came into force. If the number of valid penalty points shown on your driving licence total 6 or more during the two year probationary period immediately following your first driving test, your full driving licence will be revoked by DVLA until such time as you pass a further driving test.

Such drivers should apply for a provisional driving licence if they wish to continue driving and are subject to "learner" conditions until they pass both theory and practical parts of the driving test.

Valid penalty points incurred prior to passing the first test are taken into account if the driver commits a penalty point offence during the probationary period. Points incurred after the probationary period has expired will also count if the offence was committed during the probationary period.

Full entitlement to all categories of vehicle previously held will only be reinstated upon passing a test in any one of the driver's previously held entitlements. A successful test for entitlement to a category of vehicle not previously held will result in a full licence for that category only.

There is no right of appeal against revocation under the provisions of the Act. A driver may only appeal against the conviction, which led to the revocation.

How to Apply for Your Licence After Revocation Under the New Drivers Act

To apply for a provisional driving licence you should complete a D1 form. Your application should be sent to DVLA, Swansea, SA99 1AB together with relevant original identity documents, a photograph as prescribed in the D1 form and the appropriate fee.

Full entitlement to all categories of vehicle held previously will be reinstated upon passing a test in any one of your original entitlements.

I would weigh up how much it will cost to fight versus bending over and taking it, then redoing your test.

I've got three points, which I don't like and are killing my insurance a bit more, but would have cost me a few grand to fight it unfortunately and I'd be paying that off for quite a long time.

Different people find different things funny.

Some of your previous 'caption competions', the only way I could see I would find them funny is if I held particularly racist views Neutral.

A couple of interesting tips on avoidance here. Like it. Have to try it next time if I can. Depends on where I am when I get caught.

About the 6 points and licence revoked bit. Excuse me if I'm being a bit thick but it states if you passed your first driving test after June 97 and get more than 6 points within 2 years you lose it. Fine, but if you passed your first test many years ago, and your bike test only recently, does this mean you get a probationary period for your bike test?

Identical to the one I got.

Ignore it, then they'll send you another "reminder" saying that if you don't respond they'll take you to court.

So does that thing not work where you fill it out but don’t sign it?

I’ve been told I could post it to a mate and then he sends it back saying he doesn’t live there anymore.

heres one which works...

Agree to take it to court...
The court will give you a date..
Book that date off work (Thats if you work you lazy fuck Laughing )

Then a week or two down the line, the Court wll change the date, they ALWAYS do...

Then tell them you cannot take that day off as you have already booked the origional date off. You refuse to book it off because you will get sacked.

The courts will call it off because it will cost them too much to re-arrange again.

failing that.

Take it to court, then ask to see the Callibration Certificate for the speed trap on THAT DATE....

They will NOT beable to provide it. They never can...

Then the case is closed.

Sounds like it would work, would I seem really cocky asking for that information?
They could do me on something else, im willing to try something but as long as the fine doesn’t end up being hundreds.

They have closed that loophole, but there are still others. Fail to sign it and they just do you for failing to provide the info.

All the best

Killa, don't listen to these forum briefs mate.
They won't eat porridge for you.
Go speak to a PROPER guy in a registered office of LAW.
You know, the guy sitting behind a desk of legal papers and spends a few days in court each week and has studied law until he's been accepted by a recognised law firm/practice.
A lot of good advice at BCF but all by the by.
If it was my licence on the chopper I'd go speak to someone like:

Smithson Hinds Morris Solicitors
2 Park Square
Leeds
Tel: 0113 245 0456

www.smithsonhindsmorris.co.uk

And best of luck you sorry sod. Hope you get a result/biker magistrate. Laughing

Yeah if he's going to have to shell out on solicitors fees there's very little point, if you feel up to it take it to court, otherwise, lie in your bed. Bad luck mate.

If you passed either your car or bike driving test over two years ago, you won't have to resit your test on six points as you have held a full driving licence for more than two years.

I asked my mate who is a driving examiner about this because my car licence way only 12 months old when I started my job and I was worried about loosing it (and therefore my job) through speeding on my bike. He said that because I had already had my bike licence for four years, the rule wouldn't apply to me.

Can't be bothered to read through all this to see if it's already been asked but......Have you asked to see the photographic evidence. It's amazing how many cases are dropped coz someone fooks up and loses the frame evidence.

And yes you are entitled to see it and they HAVE to provide it but only if requested

Stolen? Sorry GYKD. Embarassed

It wasn't really stolen dom. I wasn't expecting credit. It was only passing on advice which was freely given in GYKDs' thread.
Are you still after the mods job here? Laughing

We can get free legal advice in this country which does help you to make an informed judgement.

They only have to provide it if you are going to court. Some of the scamera partnerships choose to keep the evidence to themselves until the last possible moment while trying to frighten the driver into accepting a fixed penalty ticket (with threats of higher fines and costs if they go to court).

All the best
