You can't presume someone is going to turn or not....you should've gone round the roundabout again (or timed the gap better) as you put yourself in a poor position imo....I think an insurance claim would go 50/50 IF you were lucky. Glad you're ok though  |

yeah the engine casing pretty scratched, not leaking or cracked as far as i know.
She said she decided to turn right just at the end to avoid the traffic but she takes full responsibility. Obviously any driver could decide to keep going round the roundabout, but i've never seen it whille riding and wouldn't tip toe around cars at roundabouts just in case they did. Completely agree, trust no-ones word, glad to hear you're okay, those kinds of accidents annoy me the most, some women just don't know how to use a roundabout, sorry for generalisation, but you can tell the type usually (in no way all women/men), I beep at them everytime, obviously you couldnt do so.

looking at the diagram...
Sure she was in the wrong lane but you should have noticed at the junction before the collision that she didn't exit and thus was continuing in that lane, which should have given you a lot fo time to think about what to do (whether to speed out or slow and let her pass)
right?
but its shit all the same and im sorry bro

We have spoken to her as she was young as well and we spoke to her about not claiming but her paying for my damages. She seems okay about it, but obviously people can totally change their mind at this time so we're going to speak to her again tomorrow.
The point is that she was literally AT the exit of the junction, like a meter away from being out of the roundabout and then she just turned like 90 degrees in front of me. My obs around roundabouts will be more attentive now I've had this off.

Only if they are a cyclist or horserider according to the Highway Code.
This was emphatically NOT the OP's fault (although it may have been avoided with better obs or a more tingly spidey sense perhaps) and those of you who seem to think he would go 50/50 on an insurance claim also need to go read your highway code.
Just in case you cba, section 187 is relevant in this case cos while the Code says for all users keep observing other traffic as it may not be signalling or positioned properly, section 187 says

which, if the OP's diagram is correct, he was about to do and was positioned correctly to do so the car driver should have checked for him and appears to have failed to.
A non-fault claim against her shouldn't affect your own insurance at all so I'm not sure why you wouldn't want to go down that route, if she is a young lass it's unlikely that she will be able to afford to pay you out of her own pocket, also you will need a new helmet at the very least if you hit the deck.  ____________________ Sod falling in love, I wanna fall in chocolate.  |
